Terms and Conditions

This English version is provided for convenience. The German version is the legally binding one.

1. Scope

These terms apply to all orders of fine art prints placed through the shop on nedjatnuhi.com. By clicking «Buy now» and completing the payment you accept them.

2. Provider and contracting party

Your contracting party is Nedjat Nuhi, Bahnhofstrasse 5a, 5210 Windisch, Switzerland, info@nedjatnuhi.com. The prints are produced to order by our production partner Gelato and shipped directly to you. In every case, Nedjat Nuhi remains your contracting party.

3. Offer, order and conclusion of the contract

The presentation of the motifs in the shop is an invitation to order. You choose the delivery country, the finish (framed or unframed), the frame colour and the size; the price, the place of production and the delivery time are shown to you before payment. The contract is concluded as soon as the payment via Stripe has been completed successfully. You then receive a confirmation by e-mail.

The frame preview on the product page is a rendering on screen; colour reproduction and cropping may differ slightly from the printed product.

4. Prices and payment

Prices are stated in the currency that belongs to the chosen delivery country (CHF, EUR or USD) and include shipping. Nedjat Nuhi is not registered for VAT; no VAT is shown. Payment is processed by the payment provider Stripe by card, Apple Pay, Google Pay or – depending on the country – further methods. You enter card and payment details directly with Stripe; we have no access to them.

5. Production, delivery and delivery time

Every print is produced for you after receipt of payment – as close to your delivery address as possible: unframed prints up to 30×40 cm for Switzerland in Switzerland, framed prints and larger formats in Germany, the United Kingdom or the USA. Delivery usually takes 5 to 12 working days from the order; the time shown on the product page is an estimate, not a guarantee.

Delivery goes to the address you provide at checkout. Please check it carefully; the cost of forwarding or returns caused by a wrong address is borne by you.

6. Import charges for deliveries to Switzerland

Framed prints and unframed prints from 40×60 cm are produced in Germany for Swiss customers. On delivery, Swiss Post collects import VAT and a customs clearance fee; these charges are not included in the price and are paid by you on delivery. We show you the expected amount on the product page before you buy. Unframed prints up to 30×40 cm are printed in Switzerland; no charges apply to them. Deliveries to the EU, the United Kingdom and the USA are free of customs duties.

7. Right of withdrawal and returns

You may withdraw from the purchase within 14 days of receiving the goods without giving reasons. Consumers in the EU and the United Kingdom have this right by law; we grant it voluntarily and to the same extent to all other customers, including those in Switzerland.

To withdraw, an e-mail to info@nedjatnuhi.com with your name, the order number from the confirmation e-mail and a note that you withdraw from the purchase is enough. Then send the print, undamaged and carefully packed, to the address we give you. You bear the cost of the return shipment. We refund the purchase price within 14 days of receiving the return, using the original payment method. You may be held liable for any loss in value that results from handling beyond what is needed to inspect the print.

8. Transport damage and defects

Please inspect the parcel on receipt. If the print is damaged or defective, contact info@nedjatnuhi.com within 30 days of receipt with a short description and photos of the damage and the packaging. You receive a new print free of charge or, if you prefer, a refund of the purchase price. Otherwise the statutory warranty rights apply.

9. Copyright and use

With the purchase you acquire ownership of the printed copy, but no rights in the image. All copyright and usage rights in the photographs remain with Nedjat Nuhi. The print is intended for private use; reproduction, digitisation, resale as a reproduction or commercial use are not permitted without written consent.

10. Liability

We are liable for damage only in cases of intent or gross negligence, unless the law mandatorily provides otherwise. Liability for indirect and consequential damage is excluded to the extent permitted by law. Mandatory consumer rights remain unaffected.

11. Data protection

How we process your data when you order and use the website is explained in the Privacy Policy.

12. Applicable law and place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the domicile of Nedjat Nuhi. If you are a consumer resident in the EU or the United Kingdom, the mandatory consumer protection provisions of your country of residence and the place of jurisdiction there remain reserved.
